so texting, and all those other illegal things on a hand held device, are perfectly legal provided the device is secured in a holder, and therefor not hand held.

for ther pedants, i'm talking about legalitys in relation  to hand heald devices, as obviously due care and attention can apply, and apply under a mirriad of circumstances.



what is the definition of being held....ie is pushing buttons holding...i know it is not but do the judges??
surely if its ina holder, it cant possibly be heald by a hand? thats the point of the law in the first place, no?

Looks like it's legal to send a text via a CCRT700  ........ have you ever sent a text using it? It takes forever!

Potentially. .... but legally is another story.

Or at least thats the question I'm asking. Its not texting as such, it's using a hand held device, that's illegal. As I understand it...?

It does appear that way as on Top Gear they always emphasise that they are using two-way radio's where the car is not equipped or not suited for hands-free communication.   ???

When you think about it, using a CB is not really different from talking. Having a hand off the wheel, is no different to changing gear and holding the gearstick for those that use that outdated way ;D You are watching the road whilst on CB, so the brain can multifunction in this case. However, texting, or even poncing around with Sat Nav is a different ball game. You have to 'look' at what you are doing, and 'think' what you are doing, in an entirely different way. And you can't look at a keyboard and suss which key to press whilst watching and thinking about the the road (unless you a boss-eyed) :)

Yep, has been discussed much in amateur radio circles, too. The use of 2 way radios not being explicitly outlawed, in the same way a handheld mobile phone is, won't prevent a charge of driving without due care and attention.

If we are honest about being responsible drivers and using hands-free devices while on the move, we all know that we should ideally only answer an incoming call if absolutely necessary and never make an out-going call whilst on the move, but even the law allows this. Texting and surfing shouldn't even be considered.
I have voice dial and can answer a call from the steering wheel or auto-answer but if I'm honest I still find any phone conversation distracting while I'm driving.
Modern technology means that your mobile can be in your pocket or in another part of the car and can still be used with a kit so there is no need to have access to your mobile at all.  :)
