A 20 year old woman has got 3 1/2 years for causing a car crash will saw a woman in the other car killed.She was texting a friend about a night out when she lost control of her car.It seems she initially denied using her phone,until her phone records were produced to show she'd received one message and sent two,at which point she admitted she was reading her messages at the time.She was shown arriving at court texting on her phone!

It is a modern sickness, with so many walking along and acting like zombies whilst they text.

This case is of course most tragic and avoidable with someone texting whilst driving and killing someone else.

Some people will never learn, like drink, drug, drivers. 

If I was PM I would ban texting whilst on the move or even walking.  Those idiots can walk into you, or walk in front of your car when you are driving! >:(

Very sad....but I think the fact that she is a female probably contributed to her poor driving. :-*

It's already illegal to text whilst driving, what we need is more traffic cops and less policing by camera.

I stopped a mini-bus today, the driver was using his mobile phone (on loud speaker of course  :o :o :o ) he didn't think it was an offense as it was in his hand but not to his ear!?!? Mini-bus was full of party people on their Xmas night out  >:( >:( >:(

Not texting , but seen 3 on the phone today and all speeding in a 30 zone . All of them business types .

Send all texters(drivers or not) to my boot camp.

They will soon build my barrage across the Wash. Then the money from selling all the fresh water to the South East (lots of time to car wash as no one will be texting anymore) will clear the National Debt. Fixed.

I haven't sent or received a single text message now for over nine years. I will be perfect as the community service judge!

Can you explain the difference to me between a copper talking to someone on the other end of a microphone and "Joe Bloggs" doing the same?
They are both cellular radios at the end of the day, so the device itself cannot come in to the equation.

I would hazard a guess at the "hand held" part of the equation. And normally in a police car there is a passenger doing the talking. But I guess, a police officer will be along soon to clarify

The Definition of a Hand-Held Mobile Phone

The Regulation includes any "device, other than a two-way radio, which performs an interactive communication function by transmitting and receiving data".

It states that a "mobile telephone or other device is to be treated as hand-held if it is, or must be, held at some point during the course of making or receiving a call or performing any other interactive communication function". "interactive communication function" includes:

    sending or receiving oral or written messages;
    sending or receiving facsimile documents;
    sending or receiving still or moving images; and
    providing access to the internet

There are two exemptions:

    2- way "press to talk" radios, such as used by the emergency services and taxi drivers
    Using a hand-held phone for a genuine emergency call to 999 or 112 if it would be unsafe for the driver to stop.

what is the definition of being held....ie is pushing buttons holding...i know it is not but do the judges??
