Some good news ..... ish
« on: 14 March 2013, 14:02:39 »

Some of you may recall my posts of the early part of last week regarding the broken radiator, which I believe was damaged by the aircon folks when they changed the condensor. I ended up paying full wack for a VX one as time was of the essence as they say ... £293.75 ... :(

Air con company will NOT admit liability, saying their fitters would not have done the bodge job, but they agree the "gunge" used is new, and that the coincidence of the failure and their work is remarkable .....

They have offered me 1/2 the cost of the radiator plus a years free Air Con Servicing which is on their price list as £99 inc VAT. They won't give me full cost of the radiator as if they had replaced it they could have got one for £94. (I could have got one for £120 from coolingcar if only they could have delivered in time .. but that's another story)

I have accepted the offer, begrudgingly, I'm still very miffed about the whole thing. Especially as the condensor change does not seem to have solved the problem ( Thread with THAT story shortly to go in the relevant section)

So they don't admit liability but admit it's a remarkable coincidence :-X :-X ::) ::)

As long as you are (reasonably) satisfied then it's better than nowt :y :y The full AC service in a year's time is handy though :y

My reasoning for accepting the "offer" and not fighting for more is thus ... If you remember I was considering changing the radiator due to the occasional tendency to overheat when towing the tin shed up big hills at speed .... that would have cost me £120 for one from coolingcar anyway, and the "labour" - my time - would have been the same.... (be interesting to see what happens now :) )

I've now got a genuine VX one for, effectively £150 (halfish of £293) plus the free service, although I'll bet I have to pay for a filter dryer as that doesn't seem to be included, however the existing one has been on there since Apr 08, so probably well overdue a change anyway.

I guess the only difference is the angst I went through when working "against the clock", a degree of worry during the first part of the trip as doing 500 odd miles straight after a rad transplant with only a 20 mile test drive was a tad concerning, and that it was forced on me rather than doing it at my leisure.

Air con company have now admitted their fitter put the "gunge" on the pipe, but insist that it was leaking when it arrived (rollocks !!!)... they have checked the worksheet (but won't let me see it) and apparently the fitter noted the leak at the commencement of work. ??

They agree he should have brought the matter to his supervisors attention at that point and did not.

They agree he should not have done the "fix" he did without telling anyone.

They do not agree with me that it was not leaking before hand as I would have known about it from constant "topping up" and there would have been "witness marks" of the loss of coolant/antifreeze.

They would not change their offer of 50% + a free service.

As the only other option open to me was to take the claim to the small claims court, where I could either win or lose, I reluctantly accepted the offer and have banked a cheque for £146.86 today. I also have a voucher for a free "full service" in 12 months time.

Had it been me Mr. Entwood i'd have seen them in Hell before accepting anything less than full restitution! Imho, they have shafted you Royally & caused you a great deal of upset even given the 'offer' you have reluctantly accepted.I believe they  would not have had any credible defence in the County Court given your explanation of events, but then again we live in uncertain times and stranger things happen at sea, so perhaps 'biting the bullet' may seem the best option :-\

Sometimes its just not worth the effort and worry of it all, and you just want (to play wankwordbingo) closure
