.......... doesn't really enter into the original question of the legality of the ticket.
I'd pay up & take the hit......

As I said earlier, the ticket may well be questionable as far as a ticket goes but I know from experience that if the son of the OP decides to not pay then a fixed penalty ticket of a different sort - but with the same penalty - is generated on behalf of the Court after the 28 day payment window.

Likewise, I have seen errors on said tickets that went all the way to trial in a Court in front of the great and the good and all that was done when the error was finally offerred up as a get out of jail card by the defendant, the prosecutor simply took the ticket/summons/copy complaint and corrected the date/address/reg number/whatever and simply burst the bubble of the defendant in front of the Court.

I know how I would deal with it but its the sons call, ultimately.   :y

Gee thanks for a real answer to my question Hotel 21,thats all that I wanted answered without being burned at the stake by some members on here that seem to have never put a foot wrong in the eyes of the law.
I guess that a £60 fixed penalty fine is not so bad,as contesting the ticket in court, and losing.

Alfie - my apologies.  I answered your query on page one of this thread but it was not perhaps as clear as I have since made it.   :y

I once got a parking ticket , for being on double yellows a tad longer than allowed, that had the reg number slightly incorrect. I never paid it....since that reg number wasnt my car  ;D

However that wouldnt work now, since they take piccies of the reg number  ;)

Oh and i got a no seatbelt ticket once upon a time, before i was a cabby......£10 fine then.

And for some reason, since driving 9 seaters, i never put on my seatbelt and never had my collar felt for it......im not totally sure all pc's understand the law concerning seatbelts and private hire/taxi's, so just dont bother to pull me in case their wrong  :-\

I know of a couple of Private Hire drivers who have been busted for not wearing on their way to jobs, usually a result of being given a gentle tug to slow them down a bit. They then give it large because they're in a rush and see £s being flushed away. Copper then reciprocates with a ticket for the seatbelt.  ::)

Can't help some people... ;D

Just got a ticket for speeding - difference is mate I didn't give the coppers a load of verbal and I will pay up without all the whingeing.  At the end of the day my fault - bloody annoying though!!

Even if the law allowed for you not to wear a seatbelt, why wouldn't you? It takes seconds to put on and, as far as I am concerned, is not at all restrictive.
I actually feel as though something is not right if I pull away without putting it on, feel kind of 'naked'.... :o

:y Me too.

Always have worn a seat belt, even before it became compulsory.

I cannot see the original question being anything other than a "Is there any way my son can get out of the responsibility of paying for his error". Hence the replies. The legal answer was on the first page anyway.

I suspect the quote about catching real crims/others burger munching, then looked like an attempt trying to shirk responsibility. Maybe thats why you got so many replies?

I have made many a mistake in my life. And quietly paid my dues, be it emotional or financial.

In respect to the highlighted statement above, I would be happy and even consider asking for the fine to be doubled if it can get the message into my child's head that he needs to buckle up for his own safety. Would you rather that he ended up with a serious physical injury before he learns a lesson on personal safety?

Update on the ticket, phoned the son last night with the advice given. He says ok,but also says the ticket was not signed by the PC and that he never  signed anything to say that he had received it,is this normal.
I told him just to pay the fine and don't do it again, but he's a pig headed little git.
