Hi Folks.

My Omega has been involved in an accident and has now been written off  >:(
This happened on 8th May but what with personal issues I can only now talk about it ( thanks to Mark, the alarming man).

I was following a line of traffic in Strood when a motorist on the other side of the road decided to do a U-turn right in front of me. Resulting in this:





He was a French tourist driving his LHD car. He told police that he had missed his turn, pulled in to allow the traffic behind him to clear then once clear he proceeded to do the u-turn. He said that he didn't check to see that my side was clear!
I think his is a write off too:




He's admitted liability to the police, exchanged details and now I'm facing an insurance minefield.
The insurance has offered me £800 for mine, minus £450 excess which leaves me £350 which they pay straight into my account.
I've agreed, checked my bank a few days later and only £80 has been paid in!
They said that the remainder of the policy was taken off ( my insurance was renewed last Dec, I pay over 10 mths so 5mths payments was deducted.).
Was not happy about that but the Insurance Ombudsman said that was common practice.

So apparently you can buy car insurance today , have an accident the same day and lose the rest of your premium!!

fight it mate . never happent to me allways got the money i was offeret .so they are wrong because i pay monthly as well . and never had that problem .  :( :(

John, I hope you're OK, as I'd wondered why I hadn't seen your car.
As for the insurance money, argue like hell.

And I picked up the clit, which we've still got. So at least the other party is still waiting for his payout!

and by the way you dont pay excess if its the other drivers fault . you are being had there  :( :(

I thought that if third party at fault it came off their insurance-not yours :o

I was confused too - had a couple of not my fault accidents and the other parties insurance companies phoned and basically said we accept fault what will you accept, we haggled and that was that.

Is there something different here with the other driver being French? Will you get your excess from your insurers once / if his insurer pays them?

I'm afraid that's how the insurance business is.
I've been on the phone to them virtually everyday.
I can claim for my excess from the 3rd party.
As for my insurance premiums I've sent my legal team a strong email.
So you picked up their car Nick.
Small world. Have they claimed it yet?

 first the other sides insurance must fully pay..
 
second even if it was your fault they must pay all of it..

I really feel for you :( :(

However, yes you claim your excess and any costs from the other parties insurance using legal services.  Overall you should never lose out. :y :y

there was a thread on here a week or two ago about insurance,now if i can recall as the op is the injured party the other insurance company have to return the car to its pre-accident state,.
 somebody will be along soon with a better menory than me.
 also do not let the insurance company have the car.
might be a bit late by now me thinks.
 insurance companys are bullies dont give in. >:(

feel for you gone from an 02 plate sport to £80 for something that was not your fault >:( >:(

lets hope something gets sorted in your favour

with a bit of tlc looks like it could be straightened, never the same to drive again as it isnt the same car but always a option

i am fully comp as well , but something stinks with swift cover then . they are pulling a fast one :o :o
