Drink driving penalties

So I had a phone call from a tenant this morning to tell me that his girlfriend had had a car accident last night and it turned out she was 5x over the limit.  :o   Not only that but she lied to the Police about who was driving at the time and told them it was him but he'd done a runner!  >:(   Allegedly he was at home in his PJ's watching MOTD and luckily for him apparently there were witnesses to the accident.  :y

What I've been told is that she'd gone out for the evening and drove home a distance of about 40 miles mostly motorway and dual carriagway and lost control turning into her road, bouncing off 2 cars parked on the right and hitting a transit parked on the left. The Police said the damage to the transit suggests the car was in the air when it hit and indeed she rolled her car.  ::)

It turns out that she has already had a 2 year ban for drink driving, so what penalties might she face this time?  :-\  Might she get a custodial sentence?  ???

Highly likely I would think along with a further 3 year ban at least. She will also face prosecution for no insurance and possibly no licence. The only thing that may save her from an immediate custodial sentence is how long ago the previous ban was imposed. If this ban was nearly up then it is possible that with a good solicitor she may get a community order with a substantial period of unpaid work and other requirements such as a curfew.

I think that the fact she lied will also provoke a perverting the course of justice charge which will increase the likelihood of a custodial.  I hope he had the sense to change his relationship status to 'single'  ::)

What a nice "specimen" she appears to be, trying to blame her fella. Hope he gives her the big heave ho. :(

In 1986 i was caught d/d blew 176 in the breathalyzer,cop said it was the highest reading he had seen.I got a £200 fine,100 hrs community service,and six months in jail.3 months in winson green prison,in Birmingham and 3 months at fetherstone prison witch was fun.I don't think they hand out sentences like that now,but i was guilty and you do the crime you do the time.I forgot to add a 2 year ban.

I don't think she would have got a custodial sentence for the second offence but, as has been said, perverting the course of justice is frowned upon. Stupid, inconsiderate girl.

Yes, and he wants to kick her out!  :y 

So that's where I come in and I'm trying to work out the best way to remove her from the tenancy quickly and legally.  ;)  If the silly bitch goes down it's a lot easier than if she dosn't and digs her heels in!  ::)

hopefully she will get a custodial for this,and possibly even learn her lesson.There is absolutely no excuse for drink driving,and then she compounds this by trying to blame someone else!!!

Any previous offence within 10 years will result in a disqualification of at least 36 months.
If the Court takes the view that an offence is "so serious" that it can only be adequately punished by way of a prison sentence, then the Defendant can be sent to prison, even on the first offence. Clearly, "so serious" will depend upon the circumstances of the incident and the alcohol reading. Custodial sentences would normally be considered at readings of 116 ug breath / 265 mg of blood or 355 mg of urine.The Court will consider both aggravating and mitigating factors. Aggravating factors will increase the length of a ban, and could include lack of co–operation, having children in the car, being involved in an accident etc. Mitigating factors can reduce the severity of the penalty and can include a previously good record, co–operation with the Police, early plea, but with how you've described the events I'd be surprised if she doesn't get a custodial sentance (my opinion only).
