Debt question/help
« on: 03 March 2016, 11:21:44 »

Can any one offer advice please
My daughter had a visit from the debt collectors yesterday at her house  :o it appears her ex boyfriend  ;D who she has just finished with has run up some sort of debt which they had come to collect or take her stuff away to pay the debt nothing in the house is his
He no longer lives with her he was only with her for about 6 months but he may have more debts which will come back to her address
So my question is what can she do to stop them coming back if there are any more outstanding debts he may have that have will be linked to her address
My daughter has been well and truly had by him to be honest ( he was no good right from the start but she fell for him and tried to give him a chance and this is how he has repaid her )
So is there anything she can do please

Go to the Citizens Advice Bureau (CAB), they are a great source of information :y

Are they  his debts, in his name?

Are they joint debts in both names?

Under law they cannot take anything which is not his.

My advise would be try to get a forwarding address as a short term solution to pass on and seek more pro help for the medium/long term.

I understand they can't take anything that is not his but my daughter has no receipts to say everything is hers she is just starting out on her own so most of her stuff was bought second hand or just given to her
Thank you for the replies so far though always help as usual  :y

By the same token, they are unable to prove anything at the address is his.

I think she needs to be firm with them, state that he no longer lives at the address and do not allow them in. It would, of course, help get rid of them if she has a forwarding address she can give them, as said.

A visit to the CAB is good advice, too.

Debt collectors cannot take anything from anyone, they have absolutely no rights or powers to remove goods....

Was they bailiffs or debt collectors...?

Bailiffs will give warning, they dont just turn up out the blue....

DO NOT let them in, not even once. They have to be invited in by the householder...

She needs to find out what debts are on the property, and if they are secured or unsecured...

Debt collectors will try to intimidate and scare your daughter into her paying them monies not owed by her, if they try this they are breaking the law and the Police will need to be called immediately through 999 as that call will be logged.... any other number wont be logged, but diverted to a call centre...

Iv had this with my ex-wifes debts, and even debts that she put into my name....

As others have said.
Don't let them in, Don't leave windows open.
They cannot take anything that belongs to your daughter. Upon there next visit, take copies of there id's, read the paperwork twice, ring the police, ask them to attend, and film it if possible.
As for finding the ex that's easy give the collection Agency on there next visit his mums address, also talk to his mates etc, there girlfriends, also give the collection Agency his car registration number, and works address. Finding people now days is a lot easier, thanks to Facebook etc happy hunting :y

Don't hand them a penny no matter how hard they try to intimidate her , it acknowledges the debt and you'll never be rid of the idiots

They were court bailiffs
He doesn't work so no car or anything else really to trace ( he has been a naughty boy in the past ) so he must be on the court / benefit system apparently the debt was from 2013
So I don't understand how they don't know where he is he was in jail for a while last year too

Court bailiffs, are different to debt collection Agency, or high court sheriffs.

Court bailiff collect non payment of fines, and court cost(magistrates and, crown)  debt are more phone companies, council tax etc, and sheriffs are county court collection.

I say farce-book is your friend, also don't like to say this your daughter will know how/what etc to find him..

Not true, even if you ring on 101 to report an incident, the operator has to log the call & an incident (or FWIN in GMP's case) number will be created. Every call to 999 & 101 IS recorded as well.
