Had abit of a knock 2day
« on: 22 December 2008, 22:33:31 »

Hi all on my way home today i was going down this country lane.was going about 30-35 mph car came from no where so i wacked on the brakes but prob was there was so much mud on the road the omega just kept on going so i had to go in to the hegde instede of going headon to this other car.Anyways i got out to see what dame there was om my car i have a dented wing and loads of scratches all down one side of the car and the other car only had a few little marks on it and the omega came out alot worst.Anywasy was talking to my mate about it after and he said if its true or not that my insurer will only insure me and not the other car as its a B road and have no road markings etc so the other person cant really claim on my insurance. Is this true

You are in insured to drive your car on any public road, other wise what is the point of insurance.

But why are they wanting to claim off you if they came from nowhere.  Were you on the wong side of the road, ?

If you are 3rd party , fire and theft, the insurance only pays out the damage to the other car.  Fully comprehensive then sort out both cars.

Knock for knock.  If both at blame then maybe cheaper to leave insurance out of it in the long run.

If both at fault then just repair your own cars, no insurance premium loss in process.

both insurance companies should be involved in this sort of incident (knock for knock) unless either party were seriously to blame :-?

edit:

too slow :D

As a bare minimum your insurance will cover you for third party liabilities on all public road and in most situations on private property where damage is caused to another persons' property. I've a feeling that your mate may have been trying to explain that the decision in relation to liability is a lot more subjective on a B road as there are no road markings to indicate obvious faults i.e. crossing white line etc...

The speed limit is what conditions allow up to a maximum of what the law states for that road. In your case of 30-35 mph was this considered too fast for road conditions, mud etc?
How fast was the other vehicle going? Were they doing around the same speed?
Did you exchange insurance details etc? It looks like knock for knock, but only you can decide :y
