Littlewoods sold laptop with false description.
« on: 13 February 2009, 17:37:26 »

As per title really...bought the wife a laptop as per link below.

http://www.littlewoods.com/rf/p.do/t5800-intel-core-2-duo-15-6in-laptop-with-vista-software?Ntx=mode+matchallpartial&SNtt=acer&groupId=573558236&Nu=this_product&SNtk=littlewoods_search&Np=1&SN=103+85&Ntt=573558236&D=573558236&Ntk=group_search&Dx=mode%2bmatchall&thisprod=532306163&N=103+85&Nty=1&Mis_item_id=15&Mis_item_loc_id=1&product=532306163

Ive read the description....re-read the description and then called the order line too confirm it came with bluetooth built in,operator checked and agreed it did.

Ive now tried too use the bluethooth and low and behold the machine doesn't have bluetooth....contacted Littlewoods and a very off hand pleb stated its not there problem and too contact ACER directly despite the fact ive bought the laptop from littlewoods so its them i have the contract with.

Any advice where i stand legally would be appreciated....unfortunately i no longer have the box for it as we bought it a couple of months ago.

does the model number on the laptop you have in your possession, match that of the one you ordered?

If not, then they littlewoods/acer have shipped the wrong one.

If it is, false description, they don't have a leg to stand on.

Your contract is with the RETAILER.  The warranty may be with Acer, so you could try calling Acer  to get definative answer that you could go back to Littlewoods with.  After all, it may be a hardware fault, or obscure bios setting.

The laptop is the same as pictured.

Had a good google session and it appears that while nearly all acers come with the bluetooth button very few have the hardware as would appear in my case.

Been on the phone too littlewoods while writing initial post and they had the check too say they couldn't see bluetooth advertised....wtf. ::)

Looks like im going too have too find a definite legal answer as there being of no help what so ever.

The only good thing is ive not paid for it yet just a months installment.

Shame you didn't print the advert .. :(

That was my secret weapon when I had a similar sort of argument. I took it all the way as they would not back down.

Judge in the Small Claims Court was well impressed when I produced the document, especially as printing off a web page automatically adds the date to the sheet, and he compared it to "their" sheet, supposedly describing the item but with my claim item not included..... which was dated 16 days after mine, and 12 days after the invoice date.

Suddenly they had no answer.. .. and as they were trying to claim I'd never sent the paperwork in  .. yet I had the "proof of delivery" from the Recorded Delivery by the Post Office ... became a result for me ..  :)

That advert clearly implies bluetooth by the symbol and word below WiFi ... print it and argue .. will cost very little to put in a small claim .. and you get your costs back when you win.

Why no box? With it being Acer, therefore dead cert it will go wrong in or around the warranty period, they can get out of it if you don't have original packaging.

Most laptops aren't great reliability wise, but I see a disproportional number of Acers bearing in mind they are No3 or 4 manufacturing wise.

Also Acers tend to be overpriced for the spec (which is normally knobbled)

Ambiguous advert. No mention in worded description of Bluetooth. They could argue the point that the Bluetooth symbol implies that the machine is "Bluetooth Compatible" :(

Its a similar model to mine, mine has the bluetooth symbol and switch to activate/deactivate but the module is not present in the machine, It is available as a seperate add on, and as far as I can tell its only the £600+ models that have it included.

I just bought a Nexen usb dongle, tiny minute thing and works a treat, far cheaper than the acer module.

I realise this isnt the point with regards to their description, but its an easy fix since you cant return it as you say.

cheers
