Unfortunately, due to the leftwing social twits ... whilst the MAXIMUM sentence allowable for Death by dangerous driving" is 14 years imprisonment, what is called the "starting point" is only 8 years and the courts are then FORCED to
"3. Consider relevant aggravating factors, both general and those
specific to the type of offence This may result in a sentence level being identified that is higher than the suggested starting point, sometimes substantially so.
4. Consider mitigating factors and personal mitigation
There may be general or offence specific mitigating factors and matters of personal mitigation which could result in a sentence that is lower than the suggested starting point (possibly substantially so), or a sentence of a different type."
So it is highly unlikely anyone would ever get the maximum sentence. The Judges hands are well and truly tied. If they breach these guidlines the accused will simply appeal and has a chance of getting off on a technicality.
