What's your idea of

a dual carriageway with a central reservation?

The reason for my asking is that a mate of a mate was nicked for speeding in his Artic, he was doing 50mph along a dual carrageway, but according to the traffic cop it was not a dual carrageway, because there was no crash barrier & so he should have been doing 40mph.

We have four lanes, a grass verge down the middle to seperate the opposite carriageways, but no barrier just to clear up any questions ;)

To me this is a dual carriageway, i've looked in the most up to date Highway Code book- Rule 136 states "Dual carriageways"
"A dual carriageway is a road which a central reservation to separate the carriageways"

Your thoughts?

Not sure, but I do know a dual carriageway with a barrier is 70mph and one without is 60mph.

I don't think so either, because the only stipulation in law is that a "central reservation" is in place in order for it to qualify.

Unless it has a speed sign saying otherwise.

There is a Dual Carriage way at Whistion.

years ago it was 70mph, then reduced to 60, years later it was 50, now I believe it is 40.  This DC only has a grass central res to it, but is quite wide.

Centrall reservaion could be grass or barriers, as long as it is not able to be driven on.

Sounds like the copper was in a bad mood and wanted a marl on his score card.

According to the ABD:

"For a road to be classed as a dual carriageway, the two directions of traffic flow must be physically separated by a central reservation. A road where the two directions of flow are separated only by lines painted on the road surface is a single carriageway, regardless of the number of traffic lanes that may be available to the traffic in each direction. So a road with three or four lanes is still a single carriageway if there is no central reservation."

"The most important difference in the national speed limit is between single and dual carriageways. On a single carriageway road, cars and motorcycles are restricted to 60mph and heavy goods vehicles to 40mph. On dual carriageway roads, the respective speed limits are 70mph and 50mph. It appears that some speed camera partnerships may be deliberately targeting single carriageway roads for enforcement where they have three or four traffic lanes, knowing that some drivers wrongly believe they are on a dual carriageway and a higher speed limit applies."

It would seem that plod is confused by the difference between a central reservation and a central barrier. ::)
