Can i get out of paying a parking fine?

Hey all
Went to town this afternoon, parked in Staples car park. Anyway there is a rule on this car park that you are not allowed to park there and shop elsewhere. As its most convenient car park i have been doing exactly that for some time. Anyway i got £70 parking fine, no clamp, just a notice on the car.
Is there anyway out of paying this? do they have access to a database to know where i live?
Have been caught here before, but it was just a warning about 5 years ago, obviously in a diferent car. I really dont see how they can prove i never went to staples anyway.

i'd ask for proof of the time you entered the carpark, to prove you were gone a long time

Is it a council/police ticket? If not ignore it. Let them keep writing to you and file them. DON'T call or write to them.

lol i see your point, but its alot of money to me right now. i swear these fines have increased alot, my only other parking fine was like £30 for parking in a disabled bay, admitedly this was atleast 10 years ago (paid that, deserved it, never done it since)

If it was a Euro car parks  parking lot they will write to you in approx 30 days after the fine asking/demanding payment and then possibly either A drop it or B pass it on to their debt collecting side of the firm and pursue you.....Its down to you at the end of the day what you do...As you enter into an unwritten contract that you will abide by the rules of the carpark and the landlords wishes when you enter onto their property....Or you could goto staples and ask the manager to quash it as he has the authority to do so.Play on it tell em you where pricing up laptops or business supplies  :y

Read this somewhere
Bear in mind that unlike councils, private parking companies must be able to prove, beyond doubt, in court if necessary, that YOU specifically, were driving your car. Therefore, unless they have video evidence of you driving the car at the time in question they will not be able to pursue your fine any further.


Furthermore, private car parking companies almost always charge excessive fines (over £100) when the law clearly states that a car park fine must be relevant to the costs incurred to the car park owner (more like £20 - £40). If your case ever went to court, a judge would almost certainly rule a fine of this sort illegal.


Private car park companies know full well that they would lose any case that went to court, so feel free to warn them that you are prepared to take them to the small claims court if they do not stop contacting you. This should get them off your back!

Ask them how they know you wasn't in Staples, if they say you were in their a long time, say you have a big office.

presumably the attendant saw us go to another shop or something.
my wife phone the number on the ticket when we got in purely to shout at someone i suspect lol, aparantly according to them you are supposed to move your car everytime you go to a diferent shop
yeah i think it is a euro carpark.

I know we all do this at some time or another, but at the end of the day taking up a customers parking spot costs the company money and continued abuse of their -and they mostly are theirs, not council property- car parks is what has prompted them to contract a company to enforce fines. If it was your business how would you feel? That said, £70 seems well excessive, £40 is about the norm these days, ramped up to £70 if not paid within 30 days or similar.Some companies use smart video monitoring that photographs your car going both in and out and logging the times. I would first contact the store manager to see if you can either quash the fine or else negotiate. Depends on the car park company concerned as some of them show no leeway whatsoever whilst others can be more leniant. If you choose to ignore it chances are they will be able to get your address from the index number and in addition to continued letters to you ,if you then try parking there again expect a clamp!Personally I would speak to the store manager first, and if you then have to deal with the carpark contractor tell them that £70 is far too excessive and that you'll refuse to pay it and they can take you to court etc ,but on the other hand you would be prepared to pay a more realistic fine.
