As for the "Roman Catholic Empire", this is actually the Holy Roman Empire, to which I believe you are referring. The Empire was formally dissolved on 6 August 1806. The only vestige is the hereditary titles granted during it's existence still exist (albeit in "honourary" form).

I do not know who was talking about the Roman Empire in this context, but certainly it can be debated by some within the history field that this, and the Roman Law that still exists in Europe can be considered as the last surviving living vestiges of the great Roman Empire! In all other respects the Roman Empire ceased to exist in the West in around 476 AD, which by then had its capital in Ravenna, and in the East, with its capital in Byzantium (later Constantinople), lasted until the final Roman Emperor of the East fell at Byzantium to the Turks in 1453.
Anyway back to the issue of the Pope; whatever his legal status, can you imagine the political and diplomatic implications of him being arrested in Britain?
