My turn to have an accident
« on: 26 April 2007, 15:39:47 »

Whilst coming out of a Minor Road (creep and peep) technique, i saw the car coming and stopped. Bonnet was about 1m over the give way line. Instead of steering round me (there was no other traffic) the driver decided to brake and skid into me. Nice!

The bad news, insurance company deem it to be my fault!

The good news, I have 8 years protected no claims so it doesn't really matter

The joke, they have given me a 1.2 renault clit courtsey car. My Lawn mower is more powerful!

I'd have been tempted to get out and smack him, but then my temper sometimes gets the better of me.. What an ar**hole.

Sorry to hear it mate, hope you get it back soon..

Sorry to hear about your prang Gwilym, the good thing is nobody was hurt but it's still a right pain in the a*se. :(

Good to hear you've got a powerful lawnmower, but shame about the courtesy car. ::) ;)

I hope it is back soon because i really can't fit anything into the clit and I have to keep borrowing my friends cars to carry stuff about.

I resisted the urge to smack him mainly because I was on my way home from work and about 2 minutes later one of my colleagues turned up to deal with the incident.

Ok, so it isn't a 1200cc lawnmower but you get the general idea. The point is, I have a lawnmower and all my garden is gravel and decking. Go figure!

 :o

Did his speed influence the insurance decision or did you have to take one?

As I was unable to proove the speed.....it went against me as a give way violation....

Funny that. In my opinion he was speeding to but like yourself as I couldn't prove it i had to take responilbility.

However on the plus side,i did have a deep scratch on the front bumper and now i am getting a new one.

Why did you buy the lawnmower then?

It's worrying that accidents where you have stopped, albeit perhaps a little over the line, are increasingly deemed to be give way violations these days.

What is the difference between this and having legally parked on the side of the road a little way up from the junction? OK. You're an obstruction in the road in both cases, and in both cases, only someone who's completely oblivious to his surroundings or driving at inappropriate speed, will drive into you.

Do I detect the possibility of a personal injury claim being placed by the occupants of the car that ran into you :-?
