Hit up the arris
« on: 16 July 2011, 10:32:50 »

Driving around in my cab last night, gets hit up the arse by a woman three times over the drink drive limit. Anyway all police and necessary parties are informed etc, but here comes the problem I've developed a slightly bad back. How do I go about sorting that out, got to book a doctors appointment for Monday, what else do I need to do?

Sorry to hear that Del :(

Although it will be a PITA, get to the hospital and get checked over. You need it recorded ASAP that you have developed a problem to be in a position to claim any necessary compensation

Inform the Police to ensure that they are now investigating an " injury " accident rather than the original drink drive,  damage only accident.

Unfortunately it's a standing joke, claiming whiplash after being rear-ended.  However, it actually happens and it tended to go un-noticed some years ago.  AFAIK compensation only gets paid out if it leads to incapacity or loss of earnings, but you don't know that until later so you need it checked by a reliable party (GP or NHS) ASAP just in case.  It's also not unusual for it to appear after a delay.

On a broader front, if you know you're about to be rear-ended, it's best to put your head against your (properly adjusted) headrest so that your reflexes don't have to try and react.  That said, it's also worth finding out if your headrest is worse than no headrest at all!  Some early ones had nasty framework inside with insufficient padding that could damage your head quite badly.

I hope it turns out to be a temporary strain or similar.

All the best.

I don't think you need to have lost earnings for a whiplash injury, a mate got a few thousand for pretending  ::)
As far as I know he only missed a day or two of work

I can't say I approve of this at all, but how many people would say no to a free grand or two?

Well considering I've genuinely developed a bad back, I don't see why I shouldn't put in a claim?

Go for it mate thats what you pay insurance for - just because a small minority abuse the system when people such as yourself have a genuine injury it makes you feel bad about claiming

To put it in perspecative a mate of mine went into the back of a NIssan Micra with 1 person in - When the claim come through it had changed shape to VW Sharan and had 7 occupants in all claiming for whiplash  >:(

That's right mate, you've got thousands which abuse the system, and I feel sort of obliged not to put in a claim  :-/
