Legally as Kevin says your complaint is with the seller, but I dont know if buying in a auction makes any difference.

If bought from a shop, you can demand the shop deals with the issue on your behalf, though often its easy to call manufacturer yourself so you can discuss without the hassle of 3rd parties.

However, buying from auction may be a different thing altogether.

It's got to be worth speaking to the manufacturer as you have nothing to lose. If you paid by credit card then, i believe, your contract is with the credit card company and not the retailer and ultimately you should have recourse through them. Anyway, the best thing to do is to jump through the various hoops that they put in your way until you get to either a satisfactory conclusion or you could go through small claims court if you don't get any joy.

At that point you will need to be sure with whom you have a contract.

He didn't, he paid via Paypal. Therefore the point of the transaction that the CC was involved is fine. And Paypal doesn't have the same level of legal comeback as CCs.

Using Paypal as payment method (as opposed to a Paypal checkout) means your payment to seller is via Paypal (not card), hence little comeback to card companies legally if the transaction goes wrong.
You can get a chargeback through the card company for paypal transactions..

I will try and remain amicable and resolve it in a friendly way, tho...

Yup, you could, but legally, the card company doesn't have to do anything - their part of the transaction (to Paypal) went through without issue...
