Have always wondered about car dealers?
« on: 26 August 2010, 14:55:23 »

What happens when they have a vehicle on sale for  let's say a couple months.

What happens about the V5 doc, do they have to declare it in their temporary posession, or do they just leave it until they sell to the new owner.

Likewise small traders from home say, how long do they get to re register a vehicle before DVLA start wanting proof of ownership.

There is a section on the V5C for trade. This basically puts the ownership into a state of limbo until the new owner registers it. It also doesn't add another keeper to the list :y

It is the yellow bit on the modern V5C-just sent mine off for the Rover 111; goes to DVLA and you then get a letter saying they know you are no longer the keeper.

It should work like that, but try telling that to my local Post Office's when I try and Tax the Car whilst its in limbo mode, even with a Motor Trade Cert they seem to think the Car needs to be registered to the same person holding the Insurance!  >:(

Tell me about it, it really get on my nerves. My local post office wouldn't do it. So I then told them how it was. I attempted to tax VK03 XZB, the registered keeper was shown as 'The Metropolitan Police Service'
I presented the V5C for the vehicle, it's current valid MOT and my Motor trade cert from Tradex.
They refused to do it initially. So Iasked whether they were suggesting I had somehow stolen a police vehicle with V5C from the police. I said, my insurace cert states I am insured to drive any car owned by myself or temporaily in my posession or custody. VK03 is a car, I'm insured to drive any car, so therefore it was covered. She accepted that and did it. Subsequently I now use a different post office, and they did it straight away...and do all the time now.

So if I decided to buy and sell cars (which I'm not going to do) without actually being registered as a trader, I will have to treat every car I buy as a private buy/sell deal. In other words get them registered in my name, thus adding another keeper to the list :y yes.

If you are running it as a business (I.E. as a sole trader) then no, fill in the trade section. If it as a hobby then you need to become the next keeper.

I heard there's a limit on the number of cars a non-dealer can sell in a year. Anyway, being an unofficial dealer would be hell because of the insurance nightmares. Having run off with Auto Addicts 2.2, I'm now selling my other good but lesser Omega, and sold a 2.0 a few months ago. Temporary insurance is a killer.
Registration problems are all solved by a trip to your local DVLA office - at least here they are always very helpful, even though I never get the forms right first time.

there is a limit and I think it's 6.

BUT it only refers to CGT - any more than 6 and you start to be come liable for CGT, which will only be a few percent - if they catch you.

Regarding the carry on at the post office,it comes down purely and simply to incompotent staff
I know someone who works in a main branch post office and is a bit of a car nut... she told me that a main branch office can tax any vehicle regardless of its status.... she says there are different ways to input the details into the system and most staff dont know how to do it, hence the reason they say they can't and you 'need to go to your local DVLA office'

Ah then I'm already near that, I'm on my fifth car in around 12 months.
Not bought and sold for gain, I just can't make my mind up what I want or how many either.

But.....I'm already thinking should I have sold the TD estate, should I buy another Omega.

Anyway as the origanator of this thread it sounds like a right pita to actually buy and sell cars legally.
So how do all these ebayers go on, they're not all registered as traders surely. They must get around the registration docs somehow, without it showing as a new keeper, especially if they want to move them on quickly.
I actually bought one last year from ebay, the car was last owned by someone in Nottingham. The guy I bought it from was just around the corner from me, but he had the whole V5. ::) and kept the cars at his mothers house, sounds dodgy but he was actually a nice bloke.

Can't see how ebay traders make money on it.

Capital Gains Tax is the only sanction? No problem there - with cars it's usually a capital LOSS. Could use it to offset overall annual gains - if only I had some.
