advice needed, urgent

ok, i have been given a vehicle from a friend who is in prison, i have the v5, mot & keys. the vehicle has been taken & stored by a mate of the THEN owners permision. however, having been to organise collection of said vehicle this chap wants £100. off me before he lets it go. now, i as far as im concerned dont owe a bean for it. is this a case for the police?.

I suppose it depends on what arrangements were made between your mate and the bloke who has been storing it. He might say the £100 is his fee for storage .....  :-/ :-/ :-/

Yep. Sadly i think the police might just sneer and tell you politely to go away. Again, I suppose small claims courts etc. Basically, you've got to contact 'the queen's guest' and find out what arrangement he had.

To put if another way, if you just pay up and look happy, does this mean you've 'bought' a car for 100 quid? If so thats gotta be a bargain!  :)

I would pay up. The longer he keeps it in storage the more he is likely to charge.

You can get the mark removed. Contact your local police and explain that the vehicle has a mark but you have recently purchased it. They should take the mark off then :y

Yes, I would agree with KP here even though the overall arrangement is messy - vehicle owned by someone known to the police, vehicle being held by an acquaintance of previous owner and so on.

You would also have to be confident that the vehicle was indeed owned by your friend (to preclude registration difficulties or someone else laying claim to it) and that by parting with the 'fee' the present keeper discharged all interest in it.

Having been in the audience of one of the local Police force's ANPR managers earlier this week I can report that there are several such things. It's incredible what they can achieve with a bit of data mining. :o

He did say that, if you end up with a car that's got "form" or has been cloned, etc. they will issue you with a letter that you can produce if stopped.

The area of law here appears to be bailment.

"The custodian must have physical control with the intent to maintain possession of an item to create a bailment. All involved parties decide on the terms and expectations. The law was created to protect both the bailor and the bailee. So, when items are left in a storage facility beyond the paid period, for example, the law protects the bailee, who can dispose of the items according to the bailment contract. However, if the storage facility owner fails to protect the items, the bailment protects the bailor who can sue for liability. If the facility owner did not have keys, however, a court could rule that the the owner did not have either "physical control" or "intent to posses".

Usually, bailment is an agreement through paid service such as paid storage. That way, the custodian has incentive to protect the goods. Constructive bailment is when laws surrounding abandoned property require the bailee to continue to care for the items. An example might be when a hotel guest checks out, but forgets a suitcase in the hotel room. Gratuitous bailment means there is no payment for the service such as free attended cloak or locker rooms or even borrowing a library book.

If you try and get the police involved, they will say "it's a civil matter".
Basically the storer is holding your car as security against getting paid for the storage.
Even a small claims court would probably find in the storers favour.
Best bet would be to pay the £100, get a receipt, then try to get it back off your convict friend.
If the storer is a "chancer", try haggling.
Is the car worth £100?

You will get more informed (I mean greater quantity, not neccessarily better information!) answers from the consumer action group forum.

Agreed. Indicate that you are paying "under protest", take the car and then see if there is any avenue open to you. In particular, you need to find out on what terms the storage of the car was arranged. I'm guessing that anything more than a small claims court action will cost you many times your outlay though.

Depends on your attitude towards the car, to be honest. If it's worth thousands and you want it, may as well stomach the £100.  :-/

If it's a shed and not worth shelling out the £100, leave it with the current custodian. You have the keys and the V5 so it's not going anywhere. When it becomes a pain in the @ss to him he'll be begging you to take it away. ;D
