comet strike again!!!

my best friend and colleague has been sacked this week for gross misconduct...he refused to work with an agency 2 weeks ago and got suspended for it now on the same day ste got sacked another colleague had a disciplinary for selling scrap washers and a duplicate collection to a scrap collector..now comet in their infinate wisdom allowed him to keep his job and did not give him a verbal or written warning and then promptly sacked ste 4hrs later for diagreeing with his line manager now ste has never had a warning in any shape or form and has had many letters thanking him for the job he has done from customers.....i just dont understand it...ste had a verbal agreement with our line manager not to be split whilst he recovered from a back injury sustained at work then she goes and does this!!! i am so mad at em over this i just want to leave.. all you hear each day is so an so has been suspended or so an so has got a disciplinary for doing this its driving me mad its sent morale to the lowest i`ve ever seen it people just dont want to do anything now just keep their heads below the trench line.... :( :( :(

Friend of mine worked for comet a few years ago, he left about 5 minutes before he was going to be sacked.
Anyway he took the plunge bought himself a Mercedes Van and works full time as an owner driver for I think it is DHL but don't quote me on the company. He seems to earn good money but he does work hard for it, leaves for work 5.30am each morning.

i have done some agency work when my business was quiet, my got that was an eyeopener!!!!!

a lot of people had been suspended due to misconduct....although some of those cases were dropped and the people were reinstated....and then went long term sick there was a lot of bad feeling to the management

I worked for them for 12 or so years but that was in the stores. I enjoyed the work but they were always moving the goal posts when it came to commission and always in their favour which used to pox the sales staff off and lead to poor performance so I got out. I do miss it though.

Not sure what you mean here.  Did they want your mate to transfer his employment to the agency?  If he refused they didn't sack him, he left his job...  However, if they want to transfer his employment there is a massive raft of employment law that says that si terms and conditions must not change (penisons are an exception).  If they tried to change his Ts & Cs then they are at fault.

As to the latter incident.  Disiplinary procedures must be followed to the letter by the employer.  If not then the balance of law will favour your mate.  Further, if he is injured at work and she sacked him, it is highly likely that this will be viewed as constructive dismissal.

Find another job then talk to Citzen's advice, threaten to go to employment tribunial.  THe bottom line of these things is that it is easier for the company to bung you (or you mate) a few thousand then get lawyers, doctors and other hangers on involved to fight a court case.  In my experience I have seen payout for the most hopeless of cases who deserved getting the bad news

I got out of Sales years ago because of that, punished for your own success. Had to work harder each year just to stand still. Sales managers used to hate it when I got more money than them, they were not linked to my performance.

TBH, no different from any business or enterprise.

Even in my line of work, the overtime hours available get cut year on year.  Promotion concious gaffers scrimp and save on hours to the detriment of the job, purely so they can get the pat on the head and a doggy biscuit from those further up the tree for saving money, instead of making a stance saying the service provided is sufferring.    [smiley=thumbdown.gif]

Ultimately, its Joe and Josephine Public that loose out.....   >:(
