I think you'll find that there's no such thing as British Law
It's either the laws of England & Wales or those of Scotland

That's absolutely right and is what makes me laugh about the current hysteria about the Archbishop of Canterbury's speech. We already operate two systems of law within Great Britain.
Your going to tell me next that you go to Church every Sunday ::) ::)

I get a Sermon nearly every day off the wife, dont need to go to church on Sunday ;D ;D

Well update as of today is very little to be honest.  Police are still trying to catch up with the other driver. The Police are meeting my witness tomorrow to take a statement from him about the incident.  I will keep you all updated!

At least the police are taking it seriously. If he can be identified and they have a chat with him, he'll be less inclined to claim he had nothing to do with it than if it were just you and your insurer.

In hindsight, of course, it's a shame you swerved or his involvement would have been obvious. >:(

Sorry to hear of your misfortune Richard.

I work for one of the UK's largest insurers and I am also involved in a very lengthy claim of my own at the moment that's lasted three years so far.

I can say that as long as you have an independent witness that states that the other driver's actions directly resulted in your accident, you have a good chance.

However, if neither of you caught the plate, as somebody else pointed out, it can be argued that you can't prove it was him, it could have been a visitor that just happened to have the same car.

My opinion is that you have a chance but a small one. It is worth following up though, can't hurt to try.

Keep on at the police until they give you the results of their enquiries, don't be afraid to badger them though understand of course that they have much else to do so don't expect miracles. They generally do a very good job I think, you just need a little patience.

Also, write down as many details as you can about EVERY aspect of the incident, from time, weather conditions, light, location, road conditions, road lighting etc. If it ever goes to court to be argued, having this written down now will be considered reliable but information remembered at a later date, less so. You could even get a sattelite photo of the junction from Google Earth or Microsoft Maps, it may prove useful.

Fingers crossed, hope it goes well for you.

Oh and regarding car hire, get advice from your insurer. You should always give all the information you can to your insurer - they are interested in winning claims, not losing them so they are definitely fighting your side, not his. The more you tell them, the better chance they have of giving you good advice.

Of course there are bad insurers as well as good, hopefully yours is one of the better ones!

Hi all,

Just to update you on what is happening with this as of today.

My witness has been in contact with the Police and given a statement. He has backed up everything I have said, however he did not catch the reg number unfortunately.

The Polish driver has now skipped the country according to the Police. He did not show up for work this morning and according to his boss has taken a week off to fly home. He is due back next week though so the Police are going to catch up with him then. In fairness to the Police they are really on the ball with this one and putting a lot of effort into finding him.

I had the car towed to the garage this morning and the initial assesment was at least €3,000 worth of repairs need doing. I have decided to claim from my comprehensive insurance for the moment as I cannot afford to be without a car. I hope that all costs can be reclaimed from the other drivers insurance if my case is successful against him. The insurance assessor is taking a look at the damage tomorrow but to be honest it may be close to being written off. Then I imagine will begin the battle of trying to get decent money for my car from the insurance company as they often tend to undervalue cars in this situation.

I have a 2008 Mondeo on hire now at the moment.  Nice car but the 1.6 petrol engine feels way underpowered for a car that big.

Thanks to all for advice and help so far and I will keep you updated as to what happens.

Never accept the first offer, if they do decide to write it off, check out other prices aswell on similar cars for sale, just in case :y............I have mine insured for £7,500, maybe why I pay slightly higher premium and bound by lower mileage, but if ever written off, i would not accept any less than what I have it insured for :y

Don't take this the wrong way - I don't mean to argue but two things are worth pointing out - the first offer can be a good one, not all insurers are rip off merchants - I wrote off an Orion once worth £1500 and Direct Line offered me £1800 which I snapped straight up - the assessor commented on the condition of the car and adjusted his price accordingly!

Also, the write off value depends on whether your car is insured for "market value" - determined by the insurer at the time of the claim (many use Glass' Guide, not Parker's) or "agreed value" where it's a set amount you're guaranteed to get. Most quotes ask you to value the car as standard but not all are agreed value policies despite this.

I don't mean to sound like I'm defending all insurers, just trying to help!
