This idiot should have been nicked with section 4 public order act, using threatening, abusive or insulting words or behaviour with intent.

Statements should then have been taken and idiot charged.

At court, however, idiot would have got a community punishment order and then free to return and smash windows.....

The police who attended obviously didn't want to deal with this properly.  My view is, NICK THE IDIOT - AT LEAST HE'S IN A CELL FOR A FEW HOURS AND TAX PAYERS GET WHAT THEY PAY FOR - A FIRM EFFECTIVE POLICE RESPONSE!

Sadly, it depends on the police officers that attend.  A good 'un would have done this, lazy coppers ruin reputations of police in general!

Doesn't sort out the problem of the scrote returning.  That's why courts should hand out 7 day prison sentences and £1k fines directly out of their benefits.  Clearly, the idiot doesn't work, who'd be able to employ such a idiot?

Can't you get your witnesses to make statements for you, present them to the police with a request for an explanation as to why they won't take it further, and get your local newspaper involved.
In my area, the local Homewatch group can get police CCTV cameras set up in your window to record anti-social behaviour. Worth a try? Takes time, unfortunately.

Sounds worth a try. A bit of bad publicity might prod the plod into action next time someone's in the same position.

i'm thinking the only offence he could be done for towards you is affray, being as he'd originally left, then returned with the weapon purposely to confront you in his threatening manner and i'm also thinking you would have to actually take him to court for any sort of prosecution

i wonder if the cops even questioned his possession of a claw hammer, in which case upon your complaint, could have arrested him "under suspicion" of his crime

depressing reading really, these retards know exactly where they legally stand, but funny how none of them become lawyers !!  ;)
pop a cctv camera up and if something does happen one night youve got the tw$t.

  To be honest you made the mistake of getting involved, however gallant it may have been because as said the police don't want to know and if it had come to blows between the two of you, who knows what he might have done to you in todays volatile society.

 In the long run i believe if it's on you own doorstep then walk away because the worlds going NUTS and it's not worth putting your family or property at risk especially when if you do come out on top your more likely to end up behind bars than the a**ehole who started it.

 I know it's hard to stand back and watch something like that go down but the risks far outweigh the good feeling you would get sending the s**tbag to hospital, although having said that i'm not sure what i would do in that situation, probably the same as you, and the Police wonder why people won't make a complaint.

      WHAT A WORLD!!!

I have heard comments about this and how to get away with protecting yourself.

TBH I haven't had any issues since moving to Worcester, but I have been a victim before and had to be restrained from retaliation.

This isn't affray (S3 POA) but it S4 as I stated earlier.

Under previous legislation, both were not arrestable offences but, under SOCAP, a police officer can arrest at any time within six months of the offence - providing justification can be given - which it surely merits here!!!!

It angers me, this ar$ehole should have been arrested, the coopers 'cuffed' the job; why do such coppers even attend work if they're not going to do what they're paid to do!?!!!   >:(

Just one of the reasons we left the UK.

In rural areas in Spain there seems to be very little crime or yobbish behaviour. The main reason is that everyone knows everyone and anyone stepping out of line would get a thick ear from the observer and from their dad when they got home. Bit like Britain was like 30 years ago.

I never thought I would say it but these yobs should be rounded up and sent to a boot camp (with little in the way of "rights" while they were there). I quite like the idea of front line Basra but I suspect the army doesn't want that sort but professionals.
