I got caught many years ago as a multi-drop lorry driver (which was then an official exemption, not any more) but decided it was easier to pay the fine ;)

He was in the wrong for not wearing it and again for giving lip... Pay up IMO ;) At the end of the day, it's not like be gets points for it ::)

Constantly have to kick myself to remember to put mine on :-[

3 years driving a Hackney carriage, (and not wearing one), is a hard habit to break ::)

i spent several years driving a Cab,   with a joint operator licence  (so, Hackney AND Private Hire )

i ALWAYS wore a seatbelt.

saved my life at least twice.

You should be pleased he got caught, it might teach him a lesson, and more importantly, one day, save his life.

Perhaps I have been lucky :-\  Always wore one before, and always wear it now :y

The only distinction bet Hackney carriage and Private hire, is that Private Hire drivers are only exempt if they have a fare on board. Should someone pull a knife on you, or attack you then the seatbelt is an extra complication

just pay the fine end of he got caught no need to fight it, cause next time he may be not as lucky gobbing off to the same copper who attends one through the windscreen :)

Love the OP.

Wasn't wearing his belt, so breaking the law. Then decides to be a smart arse. That wont help his cause either. Now you want to know if the ticket is legal? Probably not, but like some one above said, the court fine will be completely legal and probably cost a lot more than the ticket per se.

Plus maybe instead of trying to get out of it, you should be thanking the cop for getting your son to learn to look after his life.

I have a 25 year old I am looking after now who cannot move from the neck down due to a RTA. And guess what, his biggest regret is that he wasn't wearing a seatbelt at that time, so got thrown out of the car.

If it was my son I would be giving him a good talking to, instead of promoting/protecting his stupidity.

I don't have to wear a seat belt as far as I know ( disabled) but I always do and always have done as far as I can remember, even before it became a legal requirement. It make sense :y :y

Even if the law allowed for you not to wear a seatbelt, why wouldn't you? It takes seconds to put on and, as far as I am concerned, is not at all restrictive.
I actually feel as though something is not right if I pull away without putting it on, feel kind of 'naked'.... :o

There's a whole load answers here regarding the whys & wherefores of why we should be wearing the seat belt in the first place .......... doesn't really enter into the original question of the legality of the ticket.
I'd pay up & take the hit. But as to having to wear the belt in the first place  :-\ ............... I was about 21 when the seat belt laws came out. As I knew everything then  ::), I never used to wear it until the law said I had to. And in all honesty probably still wouldn't if I didn't have to (if I could shut the buzzer up in the Merc  ::))
