Court Today
« on: 12 February 2009, 17:35:30 »

Well I went to court today for driving whilst using a mobile phone and driving without insurance (which was a geuine silly mistake - forgot to read small print on my certificate!) And I feel they were very harsh. Even though i pleaded guilty and brought evidence showing the mistake i made and profusely apologised for taking up their time and showed complete remorse for it all they still decided to give me 8 points and £350 fine plus £60 court costs and £12.50 surcharge (wtf is the surcharge?).

I feel really badly done to! I now have 11 points on my license! I'm really thinking whether to appeal or not!

On a lighter note i've finally managed to get a job starting on monday to help me as its a very tough time to be a DJ at the moment so no more money worries hopefully!

All in all a productive day, with mixed feelings!

sorry to say it but it could have been more serious as others have said, mind you if you had done all that but nicked the car you would have probably got off with a few points, a piddly fine & some community service :(

As to ban or points.  Not claiming any moral high ground here, just trying to explain things a bit...

As you are now on 11 points, do you think that the Court now thinks that you will take more care to avoid getting the 12th point and thus a 6 month ban?  Generally the case....

You can get a ban for no insurance - its upto the Court....  Copied from Pepipoo...

Discretionary disqualification
Whenever an offender is convicted of an endorsable offence or of taking a vehicle without consent, the court has a discretionary power to disqualify instead of imposing penalty points.

Where a disqualification is for less than 56 days, there are some differences in effect compared with disqualification for a longer period; in particular, the licence will automatically come back into effect at the end of the disqualification period (instead of requiring application by the driver) and the disqualification is not taken into account for the purpose of increasing subsequent obligatory periods of disqualification.

In some cases in which the court is considering discretionary disqualification, the offender may already have sufficient penalty points on his or her licence that he or she would be liable to a 'totting up' disqualification if further points were imposed. In these circumstances, the court should impose penalty points rather than discretionary disqualification so that the minimum totting up disqualification period applies.

your lucky mate 8 points and a fine
on a mobile phone and no insurance
your very lucky they didn't take your liecence and give you the book and lock you up for 12 months

the first thing i do is when i'm driving is give my mobile to ann
as for the insurance it takes 2 mins to read the part that tells you what you can and can't do

they went to town when they did me 12 yrs ago. court on teusday 4yrs and 2 days later another 2 yrs. 2 yrs suspended and untold fines. never paid them a penny in fines. refused to pay it, told them to lock me up instead. so they didnt go any further. but it learnt me a great lesson, last yr is first offence since that day. i give no reason to pull me or arrest me. but one thing i will never do now is drive and chat on phone.

ist offence. went after a bloke and rammed his car into a dual carriageway at 70mph.

2nd offence, 3 months later. car was in pub all night after st georges day, after 12 hrs of stella and untold amount of scotch i picked car in morning. i blew 184 on 1st attempt.

i didnt have to tell this but its something im ashamed of and not afraid to admit. until all this happened i was a real wild tinker. now i would rather come out of a corner by words rather than violence. ive had one big fight in all the time ive had my kids and that was last yr when i thought id killed the bloke. and i dont want it in my life, i want peace.my body cant cope with stress anymore, hence the illnesses ive had in the last yr.  :-[ :-[ :-[
