Does anyone work for Vodafone?? or legal advice?

In September Mrs. Looknee had over £400 taken out of her bank >:( so cancelled her card etc
At the end of September had a knock at the door, so answered it and a delivery man was there needing a signiture for the parcel he was holding which was addressed to Mrs. Looknee, so I signed for it thinking she had bought something for Christmas.
She opened the parcel to find two Brand New Nokia N97 phones :-? which neither of us had ordered. The following day a letter from Vodafone came telling us what contract "We" had, which was £98 per month for both phones :o
So I got on the phone to Vodafone to explain there has been some mistake.
Around 20 phone calls later (each for about half an hour long) and not a single reply.
So on the 2nd of October I wrote a letter to the Managing Director of Vodafone with all the dates that I have phoned, explaining that I have not recieved a reply at all etc.... about the two phones that we have here...
And still no-one has contacted us to pick them up :-?

I have been telling Mrs. Looknee to sell the bloody things as I can get £500 cash for the pair of phones, but she won't....
Would we get into trouble if I did sell them?
How long is it until they become ours?
Should they be compensating us for all the phone calls made, time wasted etc??

Any help appreciated :y

Have they attempted to take a direct debit for the phone contracts yet?

as above, are they direct debiting on the contracts, also was their any paperwork in the box to show the contract?

If you renew a contract you have to accept TC's which they HAVE to read out to you on the phone, or sign in person.

If there was no paperwork inside the boxes linking you to the phones, sell them  :y

Forgot to mention that..

The paperwork that followed the phones had Mrs. Looknee's Correct Full Name and Address but the bank details were not even close to the one she had to cancel or the new one she was given :-?
We also went into the local Vodafone shop in Hanley Stoke-on-Trent explaining all this (the girl even phoned the mobile number that whoever opened the account had given, there was no such number)... and showing the letter I had sent to the MD. She then sent a copy by Fax to someone high up within Vodafone apparently she knew. But still heard nothing :o

In answer to your question, no money has been taken by Vodafone as they have the wrong details.

Was this a contract renew, or a new contract? Are these on new numbers you have never had before?

The only thing link us to the phones is they have the Correct Name and address, birthday etc for Mrs. Looknee (god knows how though) but totally the wrong bank details

If they are not taking any monies then i wouldn't be too worried about it, however for my own piece of mind i think i would run a quick equifax or possibly experian(being as its vodaphone) check to make sure that some F**cker wasn't responsible for me getting a default for a phone i didn't order or even want. :y

Was this a contract renew, or a new contract? Are these on new numbers you have never had before?

Tunnie, we have always had Virgin phones mate, so never ordered a Vodafone phone, so not a phone number I know at all mate, there is sim cards and everything inside with them

The only thing link us to the phones is they have the Correct Name and address, birthday etc for Mrs. Looknee (god knows how though) but totally the wrong bank details

If they had money out of her account then the rest of the details really arn't that difficult to find out, electoral searches etc etc. :(

If you haven't signed a contract or verbally entered into an agreement there is no contract.

Are you an existing Vodafone customer or has someone fraudulently ordered these phones out of the blue hoping to intercept them in the post perhaps?

Are Vodafone otherwise chasing you for anything relating to this alleged "contract"?

You have done all you can to resolve it. If they are not chasing you for anything I would write to Vodafone recorded delivery informing them that you have been storing this incorrectly delivered package for them, you have explained that it was not ordered and that you will dispose of it if not collected within 7 days.

Wait 7 days, check it arrived and then do what you want with them.

Incidentally, I got one of my credit cards stopped recently due to a fraudulent transaction - Vodafone! Seems like they are not asking enough questions. >:(

Sorry Daz a credit check if they have had money from the account and registered a phone in her name (credit search needs to be done) you may want to see what else they may have done >:(

Happened to me a few years back i know subscribe so i can access mine anytime. www.creditexpert.com is the address i think. Free for the first thirty days but then you must cancel or its a rolling 7 quid a month. HTH :y

the fact its got your name and address is worrying, take it into the store and ask to see the signed acceptance of TC's which you HAVE to do to take out a contract

No we are Virgin customers and have been for years Kev.
It seems asthough someone has ordered them but why I don't know as they have not got the phones to sell :-?
