Most CC company helpdesks don't really understand chargebacks, so don't assume because the helpdesk has suggested that, that it will happen. They jut raise the case, and another (faceless, uncontactable) department will take over.



The CCA fits in well with SoGA, in that the goods need to be reasonably fit for purpose, and reasonably as described.  You need, as a minimum, written proof that the item was described as perfect and unblemished, as its not unreasonable to assume a 10yr old, 2nd hand car part might  have degraded finish.


The CCA only covers goods/services bought with credit. There are other (generally lesser) protections in place for other scenarios.

Chargeback is an option that all Debit and Credit Card companies have the choice of opting into and covers all purchases made by credit or debit card, weather the item is new or used. But they will only use this option if you have tried to resolve the problem ammicably for items under £100.

This is not law. But what you are describing is Credit Consumer Act section 75 which is not chargeback but for purchases over £100 makes your Debit or Credit Card provider fully liable for both new and used products which is the law side.

I am having to use chargeback which the credit card company used for this transaction openly offers.

I don't know if they will send an inspector out or not but I have taken plenty of photo's and if needed can prove that the bootlid I bought isn't one off my car due to the different damage being one big long dent that I have a photo of that I took the day I got the car lol. And I have kept all emails sent and received showing I tried to resolve the issue.
Chargeback covers a multitude of sins that the clearing houses can use to resolve issues.  However, CCA is the only one that legally gives you the protection should the need arise.  Most banks offer an insurance scheme for other payment options, but this is not covered by CCA.

The fact that the boot is now in fit-for-purpose with just a bit of cleaning does make me fear this could easily go against you. To be honest, unless it is a cut and dry case, decissions tend to fall in the favour of the retailer, due to the shear number of customers trying it on.

The bootlid is still not as described, I have it in writing from the seller when I was looking to buy the product that there is NO MARKS but there are tons of scratches and 2 lots of rust which will have to be treated and the light has a big V shape crack in it. So fingers crossed. As I am still going to have to buy another light and do something else with the paintwork even though I spent 2 days and evenings scrubbing this bootlid at a cost of £16 with the products I had to use to get the sticky stuff off.

Update on the whole situation, been arguing with the breakers again to give them a 4th chance to rectify the situation and they have chosen the hard way, so I did some digging legally and found that Johnsons Vauxhall Spares LTD are NOT a registered company on the Companies House database, which mean they are trading ILLEGALLY so do not trade with them in any way. And the credit card company are now investigating the Chargeback Claim and will be getting a kick up the backside on Tuesday for the claim.

Should have bought my perfect one complete with spoiler & lights for the price offered to you. You kept trying to beat the price down now you`re in a worse situation. Hey ho, live & learn :y

I know, I learn't a very harsh lesson, although did try to buy it off you before I bought this one and found out it was too late as you had fitted it to yours  :'(

I am happy with my new lid and spoiler but not happy about how much effort it took to get it to the condition it is in now.

Good thing I am handy with paint tho lol

Johnsons spares & Salvage are a limited company as are Johnsons.

I think you may find they are operating an umberella company.

I have sent an enquiry to Companies House as I have tried all different variations and have checked all the addresses for ALL companies registered with the name Johnsons in which took me flipping ages. And none even come close to the address or near the location of this breakers.
