Do you think that perhaps given the problems-illness that stems from incidents like this you have a duty to hand it over to the health authoritys, and sod Tesco.

It is not so long ago when it was found that when meat was past it's sell by date. what happened the green slime cleaned off and it was put back on sale with a new ticket. Direct from thier supplier with thier conivance, which of course they deny.


The moral of the story if it aint in a can or jar dont buy it from a supermarket?

The way I see it is this:

Firstly, as far as I am aware it is not actually illegal to sell food that is past its sell-by or best-before date. The restrictions regrading expiry dates are that (a) all packed food items must have an expiry date, and (b) that once set the expiry date may not be changed by the store or by the manufacturer, i.e. if an item was not sold you can not replace the sell-by date or re-pack it to show a later date, even if the product is still good.

And, the expiry date itself is entirely down to the manufacturer, i.e. if they want to label fresh milk with a 3 months expiry date then that's their problem, and there is nothing to stop a shop from stocking items past their expiry date. It is a simple case of buyers beware.

If, on the other hand, the food you bought is found to be contaminated in any way, then this is a matter for the Food Standards Agency. But this is regardless of whether it is past its expiry date or not. So in this case you should keep in mind that any food items, even dairy products, may not actually be dangerous for human consumption if it goes past it sell by date. It may be stale or tasteless etc, but not necessarily dangerous.

Secondly, you are protected from another direction and this is because this was a remote sale. When buying goods without being able to inspect them before purchase, i.e. by mail order, over the phone, or online, you have the right to give it back for full refund within a reasonable period of time (which is not specified but generally accepted as 7 days) without having to give a reason.

So I think that what is actually driving Tesco in this case is the fear of negative publicity, and not any legal ramifications, especially as you have not actually consumed the product or got harmed by it. But there is a limit for what they would do... so I would take the £50 and run.

Now I am not a lawyer so don't take my word on it, but as said this is how I understand the situation.

Whether you are right or wrong just depends on your motives. IMO.

If you are saying that you will keep quiet if they give you enough money/freebies then I think you are in danger of a blackmail charge. If, on the other hand, you are determined to report this to the relevant authorities then you are, of course, doing the right thing. Whatever you do, it may be best to act swiftly.  :-/

to be honest the store that it comes from is possibly the worst in the tesco network, its Cunmbernauld. i m particularly unhappy about my groceries coming from a town once dubbed " britains worst" Therefore hygene, stock levels and cleanliness doesnt surprise me, i would reckon its an isolated case.

However i did think about going to the store to purchase another... :-X

And as for "britains worst town" Thats not my opinion  mind you, remember reading it in a book  ::)
:)Hello Markie. Is Cumbernauld the town with a shopping centre built over the main street? I was there 4 or 5 years ago in the truck then saw it on telly a few months later getting bad press on one of those seemed like a good idea at the time programmes. Apologies if i'm getting my towns mixed up but i visit so many!!!

good point  :y and thats what i am wrestling with, i honestly dont think they comprehend or have made enough noise in this situation and for example theres been no analysis of how this has been on shelf so long and who hasnt done their job.

Its a fight on principle now and happy to push through the authorities to see a heavier punishment but nothing to me.

Markjay - good points very well put and i dont disagree with your thoughts but i just get angered at the thought of perhaps eating that last night whilst watching the football and being very very ill today, i know thats what if....but... :-/

Firstly you're a lazy begger for letting someone else do the shopping for you!  ;D  ;D  ;D

If it were me I'd hand it all over to a higher authority, the only way these stores will change is by being hurt in the courts.

Tesco response is we will refund it and er can we have it back, ive threatened them with media, Foods Standards agency and legal action.

A diary product that out of date can ( fact) give listeria, meningitis etc etc .....

So best course of actio folks ? Tesco are taking legal advice on how to handle it and are very very worried about the impact i will have - there calling me back with a solution later today...

Why dont you just hand the cheese to the food standards and stop playing point scoring with people?

Cheers dude, the motors fine, but miss the smoothness of the barge.  :'(  But the lack of visits to the pumps makes it al worth while.  :y
