The process from deemed offence to conviction has quite a few options for common sense to be applied.
The individual who may or may not feel agrieved at the actions of another.
The Officer attending, once requested, may or may not report for prosecution.
The Procurator Fiscal (or Director of Public Prosecutions in Englandshire) may or may not forward for prosecution.
The Sheriff (aye, we still have them up here....) or Magistrate, after trial, may or may not impose a punishment/admonishment/dismissal.
At each and every stage, our old, lost and late lamented friend common sense comes into play where each player has the option to kick the case into touch as its a load of rowlocks and should never have been given life on paper.
As we now have too many liberal guru's of human rights, health and safety, ambulance chasing lawyers and cringeworthy social workers for the hard of thinking, we unfortunately now reap what we have sown.
Not for an instant suggestion riot or civil insurrection but....
.... isn't it time for a reality check??
